Justiça do Trabalho condena professora a pagar indenização por danos morais 6326z

Na última decisão da Quinta Turma do Tribunal Regional do Trabalho (TRT), uma professora foi condenada a pagar R$ 3 mil por danos morais a uma escola de Curvelo, situada na região Central de Minas Gerais. A decisão ratifica a sentença original proferida pela Vara do Trabalho local e ocorre após a ex-professora ter sido acusada de prejudicar a imagem da instituição de ensino após sua demissão.

A escola ajuizou a ação alegando que a ex-funcionária fez declarações negativas sobre a instituição a pais e alunos, o que levou a escola a ter que organizar uma reunião para refutar as acusações e restaurar sua imagem. A instituição argumentou que essas declarações prejudicaram sua reputação e causaram desconforto entre a comunidade escolar.

Em sua defesa, a professora negou as acusações e afirmou que as conversas on-line apresentadas como prova foram realizadas por sua mãe, que também trabalhava na escola. Ela também alegou que, se os comentários fossem realmente dela, estes se restringiam às questões financeiras da escola e não envolviam uma tentativa deliberada de difamação.

No entanto, uma testemunha ouvida no processo confirmou que a professora, através de mensagens no WhatsApp, informou aos pais sobre a situação financeira precária da escola e a possibilidade de seu fechamento iminente. Essa conduta foi considerada suficiente para caracterizar o dano moral à imagem da instituição.

O desembargador responsável pelo recurso decidiu favoravelmente à escola e determinou que a indenização de R$ 3 mil fosse paga pelas duas empresas envolvidas no processo, refletindo a responsabilidade compartilhada pelos danos causados.
